General Terms and Conditions
These General Terms and Conditions (hereinafter referred to as "GTC") of Korean Ginseng Ltd, as the seller (registered office: 5100 Jászberény, Fáy András utca 30.1., tax number: 27046861-2-16); e-mail: hello(at)koreaiginseng.hu, hereinafter referred to as the "Service Provider") and the rights and obligations of the visitor, customer, user (hereinafter referred to as the "Customer") using the e-commerce services provided in the www.koreaiginseng.hu webshop (hereinafter referred to as the "webshop"). (Service Provider and Customer hereinafter referred to collectively as the Parties)
1. General Terms and Conditions, Formation of the Contract between the Parties
1.1.
In addition, these GTC apply to all commercial transactions on the territory of Hungary between the Parties as described in this contract in the manner described in this contract.

Anyone is entitled to use the services of the online shop, provided that he/she places a valid order by successfully and validly entering his/her real data in the online shop and accepts the terms and conditions of these GTC as binding. The webshop does not enter into contracts with minors. By accepting the terms and conditions of sale, the customer declares that he/she is over 18 years of age.
The language of the contract is Hungarian, the contract is not a written contract. The current General Terms and Conditions are available on the webshop. The order may be modified or cancelled freely and without consequence until the start of the execution of the order. This can be done by letter, telephone or e-mail. If your order has been handed over to the courier service, you cannot cancel it.

2. Once registered, your customer profile will give you access to and use of the other convenience features of the online store, including access to your purchase history and previous purchases.
2.2 Visitors and customers can register by clicking on "Login" in the top right-hand corner of the "New customer? Register" section. To register and make a purchase, you will need to provide the following personal data: first name, last name, e-mail address, password. The registration does not need to be activated.
2.3 The Customer can log in as a registered user by clicking on "Login" in the top right corner of the webshop. In his/her account, under the "Addresses" menu item, he/she can enter addresses, modify his/her data, and under the "My Orders" menu item, details of the User's previous purchases are also available for information purposes.
2.4 The User can request the deletion of his/her account and data by sending an e-mail to the e-mail address hello(at)koreaiginseng.hu. In this case, the system administrators will delete the personal and other data contained in the user's profile from the system immediately upon receipt of the request for deletion. The data of the customers of the webshop, of the specific purchases, will be kept for the period specified by law in accordance with the Accounting Act and our Privacy Policy. We will send you an e-mail notification of the fact of deletion of user data.
2.5 In the webshop, in addition to the individual product(s), you will always find basic data and information necessary for the customer's decision, the price of the product, the parameters of the products and a photo of the product. The prices shown are gross prices, which include VAT but exclude delivery costs. By clicking on the "Order" button next to the selected products, you can add the selected product in the desired quantity to the virtual shopping cart of the online shop. You can add as many products as you wish to the shopping cart.
2.6 After adding the selected product(s) to the shopping cart, you can access the contents of the shopping cart by clicking on the shopping cart in the header. Here you can change the number of products or delete items in the shopping cart.
2.7 To order the products in the shopping cart, click on the "Order" button, where you can purchase as a registered user or without registration. If you are already registered in our system, you only need to log in, you do not need to re-enter your delivery details. If the customer also wishes to subscribe to the webshop newsletter, he can indicate this intention by ticking the appropriate box on the same page.
After selecting payment and delivery, the system calculates the current delivery costs, which are clearly displayed. In the "Order overview" section, the data can of course be modified by clicking on the "Modify" button. If everything is correct during the ordering process, you can finalise the order by clicking on "Place order". To do this, you must accept the following.
2.8 Once the order has been placed, our system will send an electronic confirmation to the Customer's e-mail address with the details of the order.
2.9 The purchase, the conclusion of the contract, is concluded upon payment of the consideration for the products ordered. The goods delivered remain the property of the supplier until the purchase price has been paid in full. The concluded contract will not be filed. The Customer is obliged to provide true data during registration or when placing the order. The Customer is responsible for the accuracy, completeness and timeliness of the information provided. If the Service Provider becomes aware that the information provided by the Customer does not (also) contain elements that are not true, the Service Provider is entitled to restrict the Customer's access to his/her own account or to exclude the Customer from using koreaiginseng.hu. The Service Provider is also entitled to restrict the Customer's access to the Customer's Personal Account or to exclude the Customer from using koreaiginseng.hu in the event that the Customer misuses the website or its services. For example, if the Customer places an order for several products, but does not take delivery of the products through his/her own fault, intentionally during delivery or after their arrival at the place of delivery.
2.10 The delivery of the ordered product(s) to the delivery company (the fact of dispatch) will be communicated to our customers by e-mail. In the case of delivery by courier, the courier service will send you an SMS on the day of delivery.
2.11 If the webshop fails to fulfil its contractual obligations because the goods specified in the contract are not available or it is unable to provide the service ordered, it is obliged to inform the customer accordingly.
3Delivery and Payment
Terms and Conditions of Delivery and Payment
3.1 Home Delivery by Courier - GLS Courier
Your parcel will be delivered by GLS Courier to the address you have specified for delivery, which can be your home or work address. Delivery is made on weekdays from 8 am to 5 pm.
Delivery time: 1-2 working days in Hungary (3-4 working days in individual cases)
Important information! Please inspect the parcel upon receipt, and in case of damage, ask for a report to be taken and do not take the parcel!
If you provide information about the delivery in the comment field when ordering, we will forward it to the Courier Service (e.g. you request a phone call). The Courier Service is not an employee of our company, so it is only responsible for the delivery of the parcel and is not entitled to act in any other way.
Once we have delivered the parcel to the Courier, we are not able to change the delivery conditions (e.g. change of payment method, delivery date, other delivery services).

3.2 Personal pick-up is possible at our headquarters (5100 Jászberény Fáy András utca 30.1.) at a time agreed in advance.
Payment methods
3.3 Cash on delivery
The products ordered must be paid to the courier in cash or by credit card upon receipt of the parcel.
3.4 Simple (OTP Mobil) credit card payment
The Simple system operated by OTP Mobil Kft. guarantees secure payment. Simple's security systems protect Customers from online credit card fraud. This well-designed technical system includes the use of encrypted channels, encryptions, algorithms, etc. Simple credit card payment has no transaction costs and is therefore free of charge for the Customer.

After submitting your order, you will be redirected to Simple's secure payment page where you can start the payment transaction by entering your card details. Processing will then start on the bank's processing systems. You will also be notified of the payment result by email and redirected back to our site.

3.7. If you do not have a PayPal registration, you can find more information and PayPal registration at www.paypal.com. After registration, you can settle the total amount of your purchase using PayPal's payment system and a PayPal account. PayPal does not share your credit card details with us.
3.8 In the case of online payments (credit card payments, bank transfers, PayPal), the Service Provider is not liable for any additional costs incurred by the Customer that depend on the payment method chosen by the Customer or the Customer's card issuing bank (in particular, but not limited to, exchange rate, other costs).Right of withdrawal, details of withdrawal
4.1 The Customer may exercise his right of withdrawal by using the model declaration provided in the Government Regulation or by means of a clear declaration to that effect, i.e. by sending it to the Service Provider by e-mail or by post. The declaration must clearly indicate the Consumer's intention to withdraw. For this purpose, the Customer may also use the model withdrawal declaration available at Koreai-Ginseng-Kft-Elallasi-Nyallasi-Ny deklarozat.pdf. Or the sample below:

4.2 The Customer may exercise the right of withdrawal from the date on which he takes delivery of the goods ordered. In the case of the sale of several products, if the delivery of each product takes place at a different time, the Customer may exercise the right of withdrawal from the date of receipt of the last product delivered; in the case of a product consisting of several lots or pieces, the Customer may exercise the right of withdrawal from the date of receipt of the last lot or piece delivered. Of course, the customer may withdraw from the purchase of the product at any time before the receipt or delivery of the product, and may notify the service provider or the operator of his intention to do so by telephone, e-mail or in writing.

.3 If the Customer wishes to withdraw from the purchase, it is sufficient to send the written withdrawal notice to the service provider within 14 calendar days of receipt of the product by post or electronic mail and must return or deliver the product to the webshop within 14 days of the date of exercise of the right of withdrawal. Please DO NOT return parcels with a postage paid (i.e. postage paid or postage paid) service, as we are unable to accept them and the parcel will be deposited at the Hungarian Post Office!
We will always check the contents of parcels and, if returned intact, we will refund the price of the product within 14 days.
4.4 In the event of withdrawal by the customer, the service provider will reimburse the full amount paid by the consumer as consideration, including the costs incurred in connection with the performance, without delay, but no later than 14 days from the date of becoming aware of the withdrawal. If the customer or consumer withdraws from the contract as provided for in this Chapter, he must return the product without delay and at the latest within 14 days of the date of notification of the withdrawal or hand it over to the undertaking or to a person authorised by the undertaking to take delivery of the product.
The supplier may withhold the amount to be refunded following withdrawal from the contract until the consumer has returned the goods or provided proof beyond reasonable doubt that he has returned them, whichever is the earlier. For the refund, the service provider, the online shop shall use the same payment method as the one used for the original transaction, unless the Customer expressly agrees to another payment method. The Customer shall not incur any additional costs as a result of the application of the refund method.
4.5 In the event of cancellation, the Consumer, the Customer shall only be liable for the direct cost of returning the product.
4.6 The Consumer shall only be liable for the depreciation resulting from the use of the product beyond the use necessary to establish its nature, characteristics and functioning. The business may claim compensation for damages resulting from the use of the product beyond the above-mentioned use and from the improper use of the product.
Attention!
4.7 The consumer, the customer may not exercise the right of withdrawal in our online store in accordance with the provisions of the Act No. 45/2014 (II.26.2014) of 26.12.2014 on the right of withdrawal.

In the case of food supplements and products in direct contact with the human body, the opening of the packaging protecting the contents of the product, the opening of the lid of the hygienically sealed container or the visible modification of the contents or the quantity of the contents of the product in the online shop may terminate the customer's right of withdrawal.
5.4.4.4.. Miscellaneous
5.1 Purchasing from the online shop implies the customer's knowledge of the technical and technological limitations of the Internet and acceptance of the potential for error inherent in the technology.
5.2 The service provider is not liable for any damage caused by connection to the online shop. It is the responsibility of the visitor to assess how to protect the data stored on his/her computer from intruders. The customer is solely responsible for his/her connection to the webshop and for the purchase in the www.koreaiginseng.hu shop. The operator cannot be held liable in case of force majeure. In particular, force majeure shall be deemed to be a failure in the Internet network that prevents the unhindered operation of www.koreaiginseng.hu and the purchase in the online shop, and the loss of data sent and received on the Internet in connection with a malfunction. The Operator shall not be liable for any damage caused by the connection to the Webshop.
5.3 In the event of any breach by the visitor of the rules contained in these Terms and Conditions, the Operator shall be free to declare the Customer's order invalid and to refuse the Customer's purchase.
5.4 www.koreaiginseng.hu hereby informs its Customers that their data will be stored for the purpose of fulfilling the contract and for subsequent proof of the terms of the contract. Your data will not be transferred to third parties, unless a third party acts as a subcontractor of www.koreaiginseng.hu in the performance of the contract. The subcontractors are not entitled to retain, use or transfer personal data provided by the webshop to any other legal or natural person in any way beyond the smooth processing of the order and the proof of the order. When processing the data, the webshop operator shall act in accordance with the Data Protection Act in force at the time and the Privacy Policy of the webshop.
5.5 The contracting parties shall make every effort to settle any disputes through negotiations.
5.6 The Service Provider shall be entitled to unilaterally amend the terms and conditions of these GTC at any time. Any amendment shall enter into force at the same time as it is published in the webshop.

6.3. If the Customer wishes to conduct and settle the consumer dispute online, he/she may do so through the online dispute resolution platform at http://ec.europa.eu/odr. The Customer may address his/her consumer complaint to the territorially competent district office. More information on this can be found at http://jarasinfo.gov.hu/.
